Transparency is all the rage - and apparently it has teeth, too!
In a recent FAQ issued by the CMS, clarification on the attestations plans and issuers need to make related to gag clauses was issued.
These gag clauses, which are prevented by the 2021 CAA, were a critical step in making sure that real plan costs are available to all, not just a select few.
Now, plans and issuers are having to go a step further and confirm in writing that there are no gag clauses present in their contracts.
